Ne var ki insan kaçakçılığı ve bu yasadışı faaliyetin ürettiği organ kaçakçılığı yahut hasadı covid-19 salgınından önce bir fenomen olarak karşımıza çıkmaktadır. 2014 yılında dünya üzerinde yaklaşık 120 bin organ nakli yapılmış ve bunların %10’unun yasadışı olarak gerçekleştiği kayda geçmiştir.
Göç yolları ve organ ağları iç içe

Göç dışı organ hasadı faaliyetleri ise, özellikle Çin örneğinde olduğu gibi kapatılma ya da yeniden iskân adı altında uzaklaştırma uygulamaları ile iç içedir.
Göç merkezlerinin, hali ile çatışma alanlarının yasadışı organ faaliyetleri için hasat sahasına haline gelişine Orta Doğu’daki örneklerden biri de Irak’tır. Toplumunun en az 11 milyonluk kesiminin şiddetli yoksulluk altında yaşadığı Irak düşük gelir nedeniyle organ hasadının yüksek olduğu ülkelerden biri olarak karşımıza çıkmaktadır. Böbrek satışının yasadışı organ sağlayıcılara kolayca ulaşılabildiği Irak’taki fiyatı 2019 yılında 6 ila 15 bin dolar arasında idi. Daha önceki senelerde ise böbrek için karaborsa en yüksek fiyatlandırma 10 bin dolardı. David Matas ile David Kilgour’un Çin merkezli organ ticaretini kaleme aldığı Kanlı Hasat kitabında ise böbrek fiyatı 62 bin dolar olarak belirtilmiştir.
2019 yılının Aralık ayında Facebook sayfasına koyduğu ilan ile kanını ve böbreğini satmak isteyen Hamid kod adı verilmiş Iraklı ise 10 bin ila 25 bin dolar arasında teklifler aldığını ifade etmiştir. Hamid, annesinin kanser ilacını alabilmek için böyle bir yola başvurduğunu ifade etmiştir. Böbreğini yine Bağdat’ta satan Hamid ile alıcı arasındaki transfer operasyonun Irak’ın kuzeyinde KBY’ne bağlı Duhok’ta gerçekleşeceği de haberlere yansımıştır.
Iraklılar gibi on yılı aşkın süredir iç savaş yaşayan Suriyeliler de yaşam koşulları, savaş ve zorunlu göçün getirdiği maddi yetersizlikleri aşmak için organlarını satışa çıkarıyor. Suriye’deki savaştan kaçarak Türkiye’ye gelen Ebu Abdullah kod adını kullanan Suriyeli maddi yetersizliklerini aşmak için organlarını Facebook üzerinden satışa sunduğunda birkaç organ tüccarından böbrekleri için 10 bin dolarlık teklifler aldığını ifade etmiştir. Teklif edilen miktar Ebu Abdullah’ın yaklaşık 30 aylık maaşına denk gelmektedir.
Suriyelilerin mülteci olarak konumları düzenli ve kabul edilmiş olanlar ile düzensiz olarak adlandırılan ve yasadışı yollarlar komşu ülkelere geçenler şeklinde iki kategoriye ayrılıyor. Lübnan’da Suriyeli düzensiz göçmenlerin arasında organ avcılığı yapan Ebu Cafer medyaya verdiği röportajında yasadışı olarak gelenlerin hayatta kalabilmek için organlarını satmaktan başka çaresi olmadığını söylüyor. Cafer’e göre Suriye’de evinde otururken bir bomba ile ölecek insanların organlarını satması onlar için bir ödül niteliğinde.
Arap Baharı’nın en şiddetli halini yaşayan Suriye ve Irak’ın organ ticareti-hasadı dosyası savaş, işgal, kamu düzeninin olmaması, göçmenlikten iyi bir yaşama kavuşma gibi tetikleyicilerin yanı sıra terör örgütleri üzerinden de ortaklaşıyor. IŞİD’in sağlık bakanı olarak atadığına inanılan İsam Ebuanza adındaki İngiliz pasaportlu doktorun Suriye’de terör örgütü şemsiyesi altında örgüt üyeleri ve hastaların organlarını alarak ‘Kırmızı Market’ denilen yasadışı organ borsasında sattığı görgü tanıkları tarafından iddia edildi.
Musul’da keşfedilen terör örgütüne ait komplekslerde de çok sayıda organları alınmış örgüt üyesi ve sivilin cesetlerinin bulunduğu iddia edildi. Benzer şekilde Türkiye’de 2005 yılında milyon kişi başına düşen bağışçı sayısı 10.5 iken bu sayının 2015 yılında 45.4 çıkmasının Suriyeli mültecilerin yoğunluğu ile örtüştüğünü gösteren çalışmalar yayınlandı. Bu çalışmaların yanı sıra Türkiye’den Avrupa’ya gidebilmek için organlarını satışa çıkaran Suriyeli göçmenlerin haberleri de medyada yer almıştır.
Muhaliflerin ve azınlıkların organlarını hasat eden ülke: Çin
İnsan hakları avukatı David Matas ile Kanada’nın eski Asya-Pasifik diplomati David Kilgour’un 2006 yılında başlayan soruşturması ile ortaya çıkan dehşet verici bir olay organ kaçakçılığı-hasadının sadece göçmenler ve düşük gelirli kesimler üzerinden gerçekleşmediğini ortaya çıkardı.
Çin’in Falun Gong üyelerini tutukladıktan sonra organlarını alıp karaborsa şekilde piyasaya sunduğunu ortaya çıkaran Matas ve Kilgour’un araştırması o dönem için Çin devletinin kayda geçirdiği 10 bin organ nakli sayısının gerçekte 6 kat, 60 bin civarında, olduğunu gösterdi.
Çin’in geleneksel inanç sistemlerinin bir karması olarak şekillenen Falun Gong, bir zihin-beden terbiye sistemi olarak 1990’larda Çin’de yayılmaya başladı. ‘90’ların sonuna gelindiğinde yaklaşık 70 milyon üyesi ile açık alanlarda Çin Komünist Partisi’nin (ÇKP) iddiasına göre “kökeni batıl ve mistik” olan Falun Gong uygulayıcıları Komünist Parti üye sayısını neredeyse geride bırakmıştı. Falun Gong üyeleri ise ÇKP’nin kendilerine üç nedenle saldırdığını ifade etti: Komünist liderlerin insanların kalplerinin ve zihinlerinin kontrolünü kaybetme korkusu, Falun Gong’un yol gösterici geleneksel ilkeleri ile Kültür Devrimi sırasında Çin halkına dayattığı komünist ideolojiye karşı duruşu ve bazı komünist yetkililerin Falun Gong’u kolay bir hedef olarak görüp siyasi bir sağlamlaştırma için seçmesi.
ÇKP ile Falun Gong uygulayıcıları arasındaki gerilim Falun Gong yapanların tutuklanması ve çeşitli askeri hapishanelere götürülmesine neden oldu. ÇKP bir gecede yaklaşık 830 bin sivilin tutuklanmasına karar verdi. Matas ve Kilgour’un araştırmasının sonuçları Çin devletinin hapishanelerde Falun Gong mahkumlarını organlarını almak için infaz ettiğini ve hasadı ‘kırmızı markete’ sunduğunu ortaya çıkardı. Matas ve Kilgour’un araştırması 2006-2007 arasında gerçekleşti ve Kanlı Hasad adını taşıyan rapor 31 Ocak 2007’de yayınlandı. Çin eski sağlık bakanlarından Huang Jeifu da 2014 yılından önce infaz edilen mahkumların organlarının organ ihtiyacını karşılamakta kullanıldığını söyledi.
Çin’deki organ hasadı Falun Gong ile bitmedi. ÇKP’ne bağlı askeri hapishanelere getirilen ÇKP muhalifi sivillerin organlarının hasadına devam etti. 2019 yılında George takma ismi ile medyaya konuşan Çinli bir doktor ülkenin batısındaki Shenyang’ta bulunan ve Çin’in en büyük askeri hastanesine getirilen mahkumların öldürülerek organlarının alındığını ve pazara sunulduğunu iddia etti.
Matas ve Kilgour zamanında, 2006-2007’de, resmi 10 bin olan organ naklinin yasadışı oranı 60 bin civarında iken askeri hastane doktorunun konuştuğu 2019 yılında yasadışı nakillerle beraber Çin’deki organ nakli sayısı 100 bine yaklaştı. 1999 yılından sonra fiyatlar sürekli yükseldi. 2005 yılında Çin’den böbrek almak isteyen yabancılar için fiyat 350 bin dolardı. 2007 yılında iç piyasada 62 bin dolar olan böbrek fiyatı ise 2019 yılında 130 bin dolara yükseldi.
Çin Organ Hasat Merkezleri
Çin’deki inanç mahkumlarından zorla organ hasadı soruşturan Çin Mahkemesi BM ile yaptığı çeşitli toplantılarda Çin hükümeti ve ÇKP’nin Falun Gong mahkumlarının yanı sıra on binlerce Uygur Türkü mahkumun bedenlerinden organlarını aldığını belirtti. Mahkeme sunduğu karar metinlerinde kendilerine sunulan kanıtlara dayanarak Çin hükümetinin Uygurlardan kan, DNA ve doku örneklerini organ hasadı maksadıyla topladığını vurguladı. Çin’in bu amaçla 19 milyona yakın Uygur Türkü’nden örnek topladığı İnsan Hakları İzleme Örgütü tarafından raporlandı. Çin hükümeti adına Türkistan bölgesi başkenti Urumçi’de Uygur organlarını hasat eden Dr. Enver Tohti’nin ifadesi de Mahkemenin kanıtları arasında yer aldı. Yaklaşık 10 aydır dünyada tarihin en riskli pandemilerinden birine neden olan korona virüsünün ilk görüldüğü yer olan Wuhan Çin’in organ hasat ettiği merkezlere ev sahipliği yapıyor.
Çoğunlukla özel sektörde servet peşindeki doktorlar ve özel hastanelerin karıştığı organ ticareti-hasadı işlemi Çin’deki yahut geçmişte IŞİD kontrolündeki bölgelerde olduğu gibi devlet veya örgütler eli ile askeri tesis ya da kapatma kurumlarında da gerçekleşebiliyor. Özellikle totaliter-kapalı toplumlarda mahkumların organlarının hasadı dikkat çekerken göçmenlerin sosyal medya ile ulaştığı organ tacirleri operasyonlar için çeşitli paravan sağlık hizmeti dernekleri veya özel hastaneleri tercih ediyor.
Organ ticareti-hasadı özellikle savaşlardan kaçan ve ekonomik nedenlerle yasadışı göç eden kesimler ile ekonomik olarak kötü durumdakiler ve ötekileştirilmiş gruplar gibi korunmasız toplulukları hedef alıyor. Organ ticareti diğer yandan küresel alternatif para transfer araçları üzerinden elde ettiği parayı hızlı bir şekilde aklayabiliyor. Bu durum ise tacirler, hasatçı devlet yahut örgütlerin bu faaliyetlerine devam etmesini kolaylaştırıyor.
