BM Uygur Bölgesi Rapor Özeti

Temmuz 2009’da Urumçi’deki protestolarla birlikte BM İnsan Hakları Yüksek Komiserliği’nin (BMİHYK) soruşturma çağrısıyla birlikte Çin, başta Uygur bölgesi olmak üzere çeşitli şehirlerde yaptığı müdahaleleri “terörle mücadele” kategorisine koyarak kendini savunmaya başladı. 

 

Mayıs 2014’de ise Çin dışındaki Uygurlu savaşçılar öne sürülerek Pekin’in “Strike Hard” politikası başladı. Çin Hükümeti, 2019 yılında yayınladığı açıklamasında “1,588 çete dağıtıldı, 12,995 terörist tutuklandı, 2,052 patlayıcı ele geçirildi, 30,645 insan 4,858 yasadışı dini faaliyet ve 345,229 yasadışı dini döküman bulundurmaktan dolayı cezalandırıldı” diye belirtti.

 

Çin’in 2019’da yayınladığı “White Paper” çalışmasında Uygur bölgesindeki tüm faaliyetlerini “terörle mücadele” ve “ayrılıkçılık” ile ilgili olduğunu öne sürdü. BM ise uluslararası hukuk ve kendi kararları gereğince Uygur bölgesindeki devlet önlemlerinin, insan haklarına uygun olması noktasındaki uyarılarını sürekli vurguladı. 

 

Pekin yönetimi, 2014–18 yılları arasında “Strike Hard” politikası kapsamında Uygur bölgesi için çeşitli birçok yasa geliştirdi. Ulusal güvenlik ve terörle-mücadele yasasını birleştirerek “terörle-karşıtı yasa” oluşturdu. Bunun yanında ayrıca din ve “aşırılıkla” ile ilgili de yeni düzenlemeleri yürürlüğe koydu. 

 

Çin’in “Terörle Mücadele Kanunu” ve “Sincan Uygur Özerk Bölgesi Uygulama Tedbirleri” (Xinjiang Implementing Measures) içeriğinde yer alan “terör”ün tanımlarında “sosyal düzenin bozulması ve diğer ciddi sosyal zararlar” gibi çok detaylı olmayan ve belirsiz ifadeler kullanıldı. 

 

Mart 2018’de çeşitli yüksek mahkeme ve savcılık kurumları ile bakanlıkların ortak çalışmasıyla “Terör ve Aşırıcılık Kapsamındaki Ceza Davalarının Yürütülmesine İlişkin Bazı Konularda Hukukun Uygulanmasına Dair Görüşler” yürürlüğe kondu. Böylece “terör” ve “aşırıcılık” ile ilgili daha detaylı açıklamalar yapılarak, bu konulardaki hükümlerin yorumlanması ve uygulanmasında rehberlik etmesi amaçlandı. 

 

Geliştirilen, detaylandırılan bu yasaların tanımlamalarıyla; yasal protestolar, muhalefet olmak ve dini pratiklerin uygulanmasının doğruca “terörizm” ve “terörist faaliyetler” kapsamına girmesinden ve uluslararası hukukla korunan bu meşru faaliyetler, kısıtlı zorlayıcı yasalara maruz kalmalarından endişe ediliyor.

 

“Sincan Uygur Özerk Bölgesi Din İşleri Düzenlemesi” kapsamında “dini aşırıcılık” şöyle tanımlanıyor; “Dini öğretilerin çarpıtılması ve aşırılığın teşvik edilmesinin yanı sıra, şiddetin, toplumsal nefretin ve insanlığa düşmanlığın teşvik edilmesi gibi diğer aşırı düşünce, konuşma ve davranış biçimleri…” lakin aşırılıkçılığa işaret eden “düşünce, fikir, içerik, işaret, giyim, faaliyetler”in tam olarak neleri kapsadığı açıklanmıyor, çok az nitelik belirtiliyor.

 

“Sincan Uygur Özerk Bölgesi Aşırıcılıktan Arındırma Düzenlemesi”ne göre “aşırıcılık” için; “kültürel ve eğlence faaliyetlerine müdahale etmek, televizyon ve radyo gibi kamu hizmetlerini reddetmek, dağınık sakal veya isim seçmekte dini aşırıcılığı yaymak, resmi aile planlamasına karşı çıkmak” gibi tanımlamalar yapılırken, Çin, bu noktada “şiddet”e değinmeden sadece “aşırıcılık”a işaret ediyor. 

 

Pekin’in bu yasaları, bireysel dini pratiklerin dahi “aşırıcılık” olarak niteleyebilmesine olanak sağlanıyor. “Aşırıcılık” ise terörizm ile birleştiriliyor ve terörle mücadele gayesi veya bahanesiyle, bu şartlar dahilinde hedeflere yönelik müdahale yelpazesini genişletiyor. Öte yandan “kitaplar, sesli ve görüntülü materyaller aracılığıyla aşırıcılığın teşvik edilmesi” de içerik olarak belirsiz tanımlamalar barındırıyor.

 

BM Raportörü, “aşırılığın” nasıl tanımlandığı ve nelerin oluşturduğuna dair öznel kavramlar sebebiyle terörle mücadelede insan hakları ve temel özgürlükler ile ilgili şunları savunuyor; “…terimin uluslararası hukuk standartlarında bir karşılığı yok ve ceza hukukuna göre de hukuki kesinlik ilkesiyle bağdaşmaz; bu nedenle de belirli temel insan haklarının uygulanmasıyla kendiliğinden uyumsuzluk içindedir.”

“Aşırıcı” ya da “riskli” olan kişileri belirleme yöntemleri

Aralık 2014’te “Sincan Uygur Özerk Bölgesi Aşırıcılıktan Arındırma Düzenlemesi” kapsamında dini aşırıcı olmakla ilgili 75 işaretin listesi yayınlandı. Ve bu listedeki davranışların şiddet veya potansiyel şiddet eylemi içermekle alakası bulunmuyor. Örneğin; “televizyon ve radyoyu kullanmamak”, “genç ve orta yaşlı erkeklerin büyük sakallı olması”, “aniden sigara ile alkolü bırakmak ve bunları kullananlarla görüşmemek”, “şarkı yarışmaları ve futbol gibi normal spor, kültürel faaliyetlere karşı olmak”. Bunlara ek olarak “deneyim edinme ve illegal dini materyal okumak için mobil mesajlaşma için WeChat ve diğer sohbet uygulamalarını kullanmak, yasadışı siyasi ve dini kitaplar, sesli-görsel ürünleri taşımak veya evde kontrol etmek, denizaşırı dini programları izlemek, dinlemek ve yaymak için yasadışı olarak uydu alıcıları, internet, radyo ve diğer ekipmanları kullanmak, hükümet propagandasına direnmek, normal filmleri ve televizyon izlemeyi reddetmek”. 

 

“Aşırıcı” ya da “riskli” olan kişileri belirlemeye yönelik yapılan bu liste, bir kişinin “terörist davranış” ya da “şiddet içeren aşırıcı” olduğunu gösteren somut ve gerçekçi olmayan unsurlara dayanıyor. Buradaki maddeler, “terörist” ya da “aşırıcı” olmaktan ziyade bireysel ya da toplu olarak İslam’ı yaşamak ya da dinin görüşlerinden öte değil. Dini, kültürel ya da bireysel tercih olarak kabul edilecek meseleler, yasa ve politikalarla aşırı olarak nitelemek, sonuçları öngörülemez ve potansiyel keyfi uygulanmasını sağlar. Bu zorlayıcı yaptırımlar aynı zaman etnik-dinsel kimlikler temelinde bireyler üzerinden ayrımcı uygulamaları kullanma riski taşır. 

Hapis ve diğer özgürlükten yoksun bırakma biçimleri

Çin hükümeti, 2019 yılında BM Irk Ayrımcılığının Ortadan Kaldırılması Komitesi’ne sunduğu raporda “yasalara uygun olarak mesleki eğitim ve öğretim merkezlerini kurarak, dini aşırıcılık ve terörün ortaya çıkıp, yayılmasına engel olduklarını” belirtti. Aynı yıl yayınlanan “Beyaz Kitap”a göre, bu merkezlere gönderilen üç farklı kategoride yer alıyor; 

 

Birinci kategoridekiler “terörist” ya da “aşırıcı” olarak mahkeme tarafından hüküm verilmiş, “potansiyel olarak topluma tehdit olmakla değerlendirilmiş” kişileri içeriyor. 

 

İkinci kategoridekiler ise “terörist ya da aşırıcı faaliyetlere zorla katılan veya buna teşvik edilen ile suç olarak tanımlanacak kadar ciddi olmayan terör ya da aşırıcı faaliyetlere katılan kimseler”i kapsıyor. Bu kişilerin merkezlere gönderilmesi polisin verdiği kararla gerçekleşiyor. 

 

Üçüncü kategoridekiler ise “aşırıcı ve terörist faaliyetlere zorla katılan veya teşvik edilen, tehlike olan ama ciddi zarara sebep olmayacak” kişilerden oluşmakla birlikte savcılık, “ciddi kötü niyetli olmaması, samimi pişmanlık, gönüllü olarak eğitime katılmak ve yardım kabul etmesi”ni göz önünde bulundurarak cezayı iptal edebilir. 

 

Çin’in Beyaz Kitap’ına göre mesleki kamplara gitmek gönüllü olmaktan ziyade adli ya da kolluk kuvvetlerinin kararları sonrasında gerçekleşen bir süreç oluyor. Suçlanan kişiye hapis veya kamp olarak iki seçenek sunuluyor, bunun neticesinde kamplar hapishanelere birer alternatif oluşturur vaziyete geliyor. BM İnsan Hakları Yüksek Komiserliği’nin 2017–19 yılları arasında kamplarda tutulan kişilerle yaptığı görüşmelerde; kendilerine kamplardan başka alternatif sunulmadığını, sevk sürecinde itiraz edebileceklerini düşünmediklerini, kamplara gitmeden önce ve orada bulunurken de avukatlarıyla görüşemediklerini belirtiyorlar. 

 

Kamplarda bulunanların aktardıklarına göre kendilerinin ne kadar süre orada kalacakları söylenmedi. Yaklaşık yarısı ara sıra aileleriyle fiziki ya da telefon aracılığıyla görüştüklerini, yarısı ise hiç görüşmediklerini, akrabalarının kendilerinin nerede olduğunu bilmediklerini ifade ediyorlar. Ayrıca orada bulundukları sürede aile üyeleri ziyaret ettiğinde onlara iyi şeyler anlatmalarını söylediklerini, yabancı bir delege ziyaret ettiğinde ise “her şeyin güzel olduğunu, her gece eve gidebildiklerini, çalıştıklarını ve yemeklerin de yenebilir olduğunu” söylemelerinin tembihlendiğini söylüyorlar. Orada bulunan bazı kişiler, kamplarla ilgili herhangi bir bilgiyi paylaşmanın yasak olduğuna dair belgelerin imzalatıldığını da ekliyorlar.

 

Çin’in bu kamp sistemi bazı temel özellikleri açısından endişe uyandırmaktadır. 

 

İlk olarak insanları, önemli bir süre kamplarda özgürlükten yoksun bırakmanın yasal dayanağı olmadığı görülüyor. “Sincan Uygur Özerk Bölgesi Uygulama Tedbirleri” ve “Sincan Uygur Özerk Bölgesi Aşırıcılıktan Arındırma Düzenlemesi” kapsam olarak oldukça belirsiz, aşırı geniş yorumlamalara karşı savunmasız, keyfi ve ayrımcı uygulamalara da son derece açıktır. Her ne kadar bu iki düzenleme, 2018 yılında kampların kurulmasına ve insanların bu noktalara gönderilmesine izin vermek için değiştirilse de bu sistem önceden beri işler haldeydi.

 

İkincisi ise “Karakaş listesi” adı verilen, gerçek olma olasılığı yüksek ve 2019 yılında yayınlanan bir devlet belgesine dayanıyor. Bu listede yer alan Uygurların neden orada tutulduklarına dair sebepler yazıyor; çok çocuk sahibi olmak, “güvensiz insan” olmak, belirli yıllarda doğmak, eski hükümlü olmak, pasaport başvurusunda bulunmak ve ülkeyi terk etmemek, seyahat etmek ya da yabancı bağlantılara sahip olmak. BM’nin görüştüğü kişiler ise bunlara ilave olarak; Çin vatandaşlığını iptal etmeye çalışmak ya da komşu ülkeye giderek çifte vatandaş olmak, Whatsapp uygulamasını indirme sebeplerini kamplara gönderme için yeterli olduğunu söylüyorlar. Bu nedenler arasında çok çocuk sahibi olmak, “güvensiz insan” olmak, belirli yıllarda doğmak, eski hükümlü olmak, peçe veya sakal takmak, pasaport başvurusunda bulunmak ve ülkeyi terk etmemiş olmak vb. sayılabilir. Ayrıca BM’nin görüştüğü diğer kişilere ise basitçe bir listede oldukları veya kotanın doldurulması gerektiği söylendi. Öznel araçlarla yürütülen değerlendirmeler neticesinde insanların Çin’deki kamplarda keyfi olarak alıkonulmaları riski epey yüksek. 

 

Üçüncüsü ise insanların kamplarda bulunmalarının sebebi, süreleri, avukatlarından yoksun bırakılmaları ve tahliye şartlarıyla ilgili bilgilendirilmemeleri. BM’nin görüştüğü kişiler, salıverilmelerinden kısa bir süre önce neden kamplara götürüldükleri konusunda kendilerine açıklandığını belirtiyorlar. Çin hükümeti 16 Ekim 2018’de yayınladığı videoda kişi ve ailesine terör faaliyetlerine katılım noktasında bilgilendirme yapıldığını belirtse de BM’nin görüştüğü bir kişi “Ne için orada olduğum ve ne kadar süre kalacağım bana söylenmedi. Benden bir suçu itiraf etmem istendi ama neyi itiraf edeceğimi bilmiyordum.”

 

Çin hükümeti, kampların görevini “idari gözlem temelli siyasi yeniden eğitimden, daha geniş amaçlı düzene” doğru üretken bir istihdam olarak görüyor. Hükümetin, Beyaz Kitap’ta kamplarda “standart sözlü ve yazılı Çince, yasaları anlamak, mesleki beceriler ve aşırılıktan arındırma” gibi bir takım dersler içeren müfredat olduğunu açıkladı.

 

Dördüncü olarak, kamplardaki eğitimin doğası ve işlevsek fonksiyonu ayrıca yeniden politik eğitimin yöneliminde endişe oluşturuyor. Kamplardaki eğitim politikasının “kısmen yüksek güvenlikli ve yüksek gözetim ortamlarında yürütülmesi” kaygıya yol açmakla birlikte BM’nin Çin hükümetinden istediği müfredat ile “idari gözlem temelli siyasi yeniden eğitimden, daha geniş amaçlı düzene doğru üretken bir istihdam”a dair bilgi isteği cevaplanmadı.

 

Nihai olarak, söz konusu kamplara gönderilme kriterleri büyük ölçüde etnik, dini ve kültürel kimlik ile ifade biçimlerine dayalı. Kamplarda özgürlükten yoksun bırakmanın ayrımcı bir şekilde uygulandığına dair endişe vardır ki bu gözaltı merkezlerindeki keyfi tutuklamalarla birleşmektedir.

 

Çin hükümeti hala bu kamplara gönderilen ve “yeniden eğitimlerden” geçenlere dair veri yayınlamadı. BM Irk Ayrımcılığının Ortadan Kaldırılması Komitesi’nin 2018 yılındaki raporuna göre Çin’in bu kamplara gönderdiği insanların sayısının on binlerce ile bir milyonun arasında değiştiği düşünülüyor. Beş yıl boyunca Çin hükümetine kamplara giden insanların sayılarını paylaşması için yapılan çağrılara karşılık Pekin, bunun mümkün olmadığını, yeniden eğitim sisteminin hareketli olduğunu, sürekli insanların girip çıktığını açıkladı.
